Will I get points for receiving an Improper Equipment?
There are two point systems for those who have received traffic violations. There are Division of Motor Vehicle (DMV) Points which primarily impact an individuals ability to maintain their license without it becoming revoked or suspended. Additionally, insurance points are assessed for moving violations within the state of North Carolina. Insurance points are the primary culprit for causing insurance rates to increase. The North Carolina Department of Insurance sets the rate schedule for insurance increases associated with insurance points.
The charge of improper equipment is a non-moving violation in North Carolina. Therefore a conviction for improper equipment carries zero DMV points, and zero insurance points for North Carolina drivers. However, an outcome of improper equipment does show up on your North Carolina driving record.
Be aware that insurance can be raised by legitimate insurance carriers for at least two reasons. First, if you receive insurance points; as stated an outcome of improper equipment does not cause one to receive insurance points. Second, if your insurance carrier is not interested in continuing to insure you, they have the option of placing you in the State's reinsurance program. Those licensees who are placed into the reinsurance program are being placed into a pooled insurance program where multiple insurance companies who do business in North Carolina share in the risk of covering that insured. Individuals who are placed into the reinsurance program are subject to higher rates.
